5. Booking Process and Confirmation

5.1 Booking Request

All bookings begin with a booking request submitted through our website, email, phone, or online booking system. A booking request does not constitute a confirmed booking until we have issued a booking confirmation per Section 5.3.

5.2 Deposit Requirements

To confirm your booking, the following non-refundable deposits are required. For Personalized Travel Services, deposits are determined by Fora Travel's requirements and the specific services booked, typically ranging from ten to thirty percent of total booking value or as specified by suppliers, with deposit requirements communicated at time of booking request. For Relocation Services, Location Scout Packages require a fifty percent non-refundable deposit ranging from $1,750 to $2,500, while Full Relocation Packages require a fifty percent non-refundable deposit ranging from $6,000 to $9,000, both due at time of booking. For Group Travel Experiences, a $1,500 per person non-refundable deposit is due at time of booking, and if booking within sixty days of departure, full payment is required. For Digital Products, full payment is due at time of purchase with no deposits required, and products are non-refundable upon delivery.

5.3 Booking Confirmation

A contract between you and Beneath the Map Travel comes into existence when we receive your completed booking request with all required information, we receive your non-refundable deposit, we issue a booking confirmation invoice, and you receive confirmation via email or other agreed method. The booking confirmation will specify services booked, dates of service,

pricing and payment schedule, participants' names, special requests or requirements noted, payment due dates, and cancellation terms applicable to your booking.

5.4 Online Booking Confirmations

For bookings initiated through our online booking system, submission of an online booking form constitutes a booking request only. You will receive automated acknowledgment of receipt, but booking is not confirmed until we issue formal booking confirmation per Section 5.3. We reserve the right to decline booking requests at our discretion. Typical response time is one to three business days.

5.5 Accuracy of Information

You are responsible for ensuring all information provided in your booking request is accurate and complete, including full legal names exactly as they appear on passport, date of birth, passport numbers and expiration dates, nationality, contact information, dietary requirements or restrictions, medical conditions requiring disclosure, and special needs or accessibility requirements. Any errors or omissions in the information you provide may result in additional fees, inability to provide services, or cancellation of your booking without refund.

6.4 Currency

All prices are quoted in U.S. Dollars (USD) unless otherwise specified. If you pay in a currency other than USD, the exchange rate applied will be that determined by your payment processor at the time of transaction.

6.5 Payment Confirmation

You will receive written confirmation by email or electronic means for each payment received. Please retain all payment confirmations for your records.

7. Pricing and Price Changes

7.1 Pricing Validity

Prices are valid as quoted at the time of your booking confirmation. We reserve the right to change prices for future bookings at any time without notice.

7.2 Variable and Seasonal Pricing

Our pricing may vary based on demand and availability, seasonality, exchange rate fluctuations, supplier cost changes, and other market conditions. It is possible that different clients pay different prices for the same services booked at different times.

7.3 Price Increases After Booking

We reserve the right to increase the price of your confirmed booking in the following circumstances. If significant unfavorable changes in exchange rates occur affecting costs of

services provided by foreign suppliers, we may adjust pricing up to thirty days before departure. If significant increases in fuel surcharges or transportation cost increases occur beyond our control, adjustments may be made up to thirty days before departure. For government-imposed changes including new or increased taxes, new or increased fees or levies, or government-mandated surcharges, adjustments may be made up to departure date if unavoidable.

7.4 Price Increase Rights

If we exercise our right to increase prices, we will notify you in writing immediately. You will be responsible for increases up to two percent of the total booking price. For increases exceeding ten percent of total booking price, you may accept the increase and proceed with booking, or cancel the booking and receive full refund of all payments made. You must notify us of your choice within fourteen days of receiving notice. Failure to respond within fourteen days constitutes acceptance of the price increase.

7.5 No Price Reductions

We are not obligated to reduce your price if costs decrease after your booking is confirmed, unless required by law.

8. Cancellations and Refunds

8.1 Cancellation by Client

All cancellations must be received in writing (email acceptable) to info@beneaththemaptravel.com and will be effective from the date we receive your written cancellation request.

8.2 Cancellation Fees - Personalized Travel Services

Cancellation fees for personalized travel services depend on the specific suppliers and services booked. General guidelines are as follows: more than sixty days before departure results in loss of deposit; fifty-nine to thirty-one days before departure incurs fifty percent of total booking price; thirty to fifteen days before departure incurs seventy-five percent of total booking price; and fourteen days or less before departure results in one hundred percent of total booking price with no refund. Specific cancellation terms for your booking will be provided in your booking confirmation and may differ from these general terms based on supplier requirements.

8.3 Cancellation Fees - Relocation Services

For Location Scout Packages, cancellation more than thirty days before service commencement results in loss of deposit (fifty percent), twenty-nine to fifteen days before service commencement incurs seventy-five percent of package price, and fourteen days or less results in one hundred percent of package price with no refund. For Full Relocation Packages, cancellation more than sixty days before service commencement results in loss of deposit (fifty percent), fifty-nine to thirty-one days before service commencement incurs seventy percent of package price, and thirty days or less results in one hundred percent of package price with no refund.

8.4 Cancellation Fees - Group Travel Experiences

Cancellation eighty-nine to sixty-one days before departure incurs fifty percent of total experience price. Cancellation sixty to thirty-one days before departure incurs seventy-five percent of total experience price. Cancellation thirty days or less before departure results in one hundred percent of experience price with no refund.

8.5 Digital Products

Digital products are non-refundable once delivered or accessed. You may request a refund within twenty-four hours of purchase if you have not accessed or downloaded the product.

8.6 Refund Processing

Refunds, if applicable, will be processed to the original payment method and will be issued within thirty days of written cancellation request. Any credit card processing fees are non-refundable, and refund amounts are subject to currency exchange rates at time of refund.

8.7 Partial Cancellations

If you cancel one or more travelers from a multi-person booking, per-person cancellation fees apply for each cancelled traveler. Remaining travelers may face price increases if per-person rates change, single supplements may apply if occupancy changes for group travel, and we may require full cancellation and rebooking if significant changes occur.

8.8 No-Show

Failure to show up for any service without prior cancellation will be treated as a cancellation on the departure date, resulting in one hundred percent cancellation fee (total forfeiture), no refunds, and no credits or future travel benefits.

8.9 Travel Insurance Strongly Recommended

We strongly recommend purchasing comprehensive travel insurance immediately upon booking to protect against cancellation fees, medical emergencies, and other unforeseen circumstances. See Section 10 for detailed insurance requirements.

9. Changes to Bookings

9.1 Changes Requested by Client

Any changes to your booking including dates, services, or participants are subject to availability of alternative services, our approval and acceptance, Third-Party Supplier approval and acceptance, payment of change fees as outlined below, and payment of any cost differences.

9.2 Change Fees

Administrative fees for changes requested by clients are as follows. Name changes cost $100 per name change per person, are subject to Third-Party Supplier approval, may be subject to supplier-imposed fees, are not permitted within fourteen days of departure for most services, and passport name changes must match exactly. Date changes cost $150 per booking plus any difference in pricing or supplier fees, are subject to availability, and are not permitted within thirty days of departure. Service changes cost $100 administrative fee per change request plus any cost differences in services, are subject to availability, and are limited or prohibited within thirty days of departure.

9.3 Changes by Beneath the Map Travel

We reserve the right to make minor changes to bookings, which may include reasonable changes to accommodation of similar standard, changes to ground transportation of similar standard, changes to meal venues of similar standard, reasonable adjustments to itinerary timing, and substitution of guides or facilitators with equivalent qualified personnel. Minor changes do not entitle you to compensation or cancellation rights, and we will inform you of minor changes as soon as reasonably practicable.

Significant changes are those that substantially affect the nature of your booking, including change of departure date by more than forty-eight hours, change in primary destination, significant reduction in included services, or change resulting in price increase exceeding five percent. If we make a significant change before departure, we will notify you as soon as reasonably possible, and you may choose to accept the changed booking, accept an alternative booking of comparable value if available, or cancel and receive full refund of all payments

made. You must notify us of your choice within seven days, and compensation may be provided depending on timing and nature of change.

We reserve the right to cancel any booking at any time prior to departure. If we cancel your booking other than for Force Majeure as detailed in Section 18, the following compensation applies. Cancellation more than ninety days before departure results in full refund of all payments made with no additional compensation. Cancellation eighty-nine to thirty-one days before departure results in full refund of all payments made plus compensation of $250 per person or alternative booking of equal or greater value. Cancellation thirty days or less before departure results in full refund of all payments made plus compensation of $500 per person or alternative booking of significantly greater value.

9.4 Minimum Participant Requirements

Group travel experiences and certain services require minimum participant numbers. Group Travel Experiences require a minimum of four participants with a maximum of twelve. Certain Travel Services have minimum requirements set by suppliers. If minimum numbers are not met, we will notify you no later than thirty days before departure, and you may accept cancellation with full refund, accept alternative dates or itinerary, or pay supplemental fee to guarantee departure if offered.

9.5 Changes Not Permitted

The following changes are generally not permitted: name changes within fourteen days of departure, date or service changes within ten days of departure, any changes to permits or bookings that cannot be modified such as Inca Trail permits, and changes after services have commenced.

10. Travel Insurance Requirements

10.1 Mandatory Travel Insurance

Comprehensive travel insurance is mandatory for all bookings and must be purchased no later than fourteen days after making your deposit. Your travel insurance policy must include at minimum medical coverage of at least USD $200,000, emergency medical evacuation and repatriation, trip cancellation and interruption coverage, coverage for destinations included in your booking, twenty-four-hour emergency assistance, and coverage for all participants on your booking.

10.2 Proof of Insurance

You must provide proof of qualifying travel insurance at time of final payment or no later than thirty days before departure, whichever is earlier. Failure to provide proof may result in cancellation of your booking. Proof must include policy number, insurance company contact information, confirmation of coverage types and amounts, emergency contact numbers, and dates of coverage matching your travel dates.

10.3 Insurance Recommendations

We recommend purchasing insurance that includes "Cancel for Any Reason" coverage, which typically requires purchase within fourteen days of deposit, pre-existing medical condition coverage, adventure sports coverage if applicable, coverage for valuable items and equipment, delayed departure and missed connection coverage, and coverage for epidemics or pandemics if traveling during such events.

10.4 We Are Not Insurance Providers

Beneath the Map Travel does not provide travel insurance and is not responsible for verifying adequacy of your coverage, claims related to insurance, costs arising from lack of adequate insurance, or disputes with insurance providers.

10.5 Medical Insurance for Relocation Services

Clients booking relocation services must either maintain comprehensive international health insurance, immediately obtain qualifying health insurance upon relocation, or demonstrate adequate financial resources for medical expenses.

11. Traveler Responsibilities and Requirements

11.1 Information Accuracy

You are responsible for providing accurate, complete, and current information; ensuring all names match government-issued identification exactly; updating us immediately of any changes to your information; verifying all details in booking confirmation; and notifying us immediately of any errors or discrepancies.

11.2 Pre-Departure Preparation

You are responsible for reading all pre-departure information provided, attending any required pre-departure meetings or orientations, understanding the physical, cultural, and logistical requirements, preparing appropriately for destination climate and conditions, packing

appropriate clothing and equipment, and arranging travel to and from meeting points unless transfers are included.

11.3 Communication

You must monitor email regularly for communications from us, check spam and junk folders for our emails, respond promptly to requests for information, maintain updated contact information with us, provide emergency contact information for next of kin, and maintain communication device during travel when possible.

11.5 Acceptance of Risk

By booking with us, you acknowledge that travel to certain destinations involves inherent risks, that you have reviewed country-specific travel warnings and advisories, that you accept these risks voluntarily, that you will take reasonable precautions for your safety, and that you will follow safety guidelines provided.

11.6 Financial Responsibility

You are financially responsible for all booking payments per these Terms, personal expenses and incidentals, costs of optional activities, medical expenses and medications, costs arising from your failure to comply with requirements, costs arising from your inability to participate in services, damage you cause to property, and additional costs from your behavior or misconduct.

12. Health, Medical, and Fitness Requirements

12.1 Medical Disclosure

You must disclose at time of booking any medical conditions that may affect participation, any medications you take regularly, any allergies especially food allergies, any mobility limitations or accessibility needs, any mental health conditions requiring support or accommodation, pregnancy, and any recent surgeries or injuries. Failure to disclose relevant medical information

may result in denial of service without refund, termination of services without refund, liability for costs arising from non-disclosure, or inability to claim on insurance.

12.2 Fitness Requirements

Many of our services, particularly group travel experiences and cultural immersion experiences, may require walking significant distances on uneven terrain, navigating stairs without elevators, adapting to basic accommodation conditions in some locations, tolerance of different food and water, and ability to manage in environments with limited medical facilities. You must assess whether you have the physical and mental fitness required. We can provide detailed information about specific requirements for your booking.

12.3 Medical Assistance During Travel

We are not medical professionals and cannot provide medical advice. You are responsible for obtaining necessary medical care and for all costs of medical treatment. We will assist in connecting you with local medical facilities when requested. Emergency medical evacuation costs are your responsibility, which is why insurance is required as detailed in Section 10.

12.4 Medical Clearance

For certain services, we may require medical clearance from a licensed physician, completion of medical assessment forms, or proof of ability to participate safely. This especially applies to relocation services and extended travel experiences.

12.5 Mental Health

We are committed to supporting travelers with mental health needs, but we are not mental health professionals and cannot provide therapeutic services. You must be stable enough to travel independently or with appropriate support. We reserve the right to decline service to individuals in active mental health crisis. We will provide referrals to local mental health resources when possible. See Section 12.7 regarding our right to terminate services.

12.6 Pregnancy

If you are pregnant, you must disclose this at booking and throughout pregnancy, must provide medical clearance to travel, and are responsible for assessing risks to yourself and unborn child. Many airlines restrict travel after twenty-eight to thirty-six weeks, and travel insurance may have pregnancy-related exclusions.

12.7 Right to Refuse or Terminate Services

We reserve the right to refuse service or terminate services without refund if we believe your health or fitness poses risk to yourself or others, if you fail to disclose relevant medical conditions, if your condition deteriorates during services, if you cannot participate safely in booked activities, or if medical professionals advise against your continued participation.

13. Passports, Visas, and Documentation

13.1 Passport Requirements

You are solely responsible for ensuring you possess a valid passport that is valid for at least six months beyond your intended return date, has sufficient blank pages typically two to four for entry and exit stamps, is not damaged or altered, contains accurate information matching booking details, and meets specific destination requirements.

13.2 Visa Requirements

You are solely responsible for obtaining all necessary visas, including entry visas for all countries on your itinerary, transit visas if required, special permits such as work permits or residence permits if applicable, return or onward travel documentation if required, and visa validity covering entire stay plus buffer.

13.3 Our Role in Visa and Documentation

We provide general information about documentation requirements and may connect you with visa services or immigration attorneys, but we are not responsible for visa denials or delays, do not guarantee accuracy of visa information provided, and advise that requirements change frequently so you must verify with appropriate authorities.

13.4 Consequences of Documentation Failures

If you fail to obtain or present proper documentation, you will be denied boarding, entry, or service; no refunds will be provided; you are responsible for all costs incurred; cancellation fees per Section 8 apply if you cannot travel; and you may face deportation, fines, or detention.

13.5 Special Permits

Some activities or destinations require special permits. We will inform you of known permit requirements and may assist in obtaining permits when part of our service, but you are responsible for ensuring timely permit acquisition. Permits may be non-refundable and non-transferable, and some permits like Inca Trail permits cannot be changed once issued.

13.6 Health Documentation

You may need vaccination certificates such as Yellow Fever or COVID-19, health declarations or medical forms, negative test results, or prophylaxis documentation such as malaria medication. You are responsible for obtaining required vaccinations well in advance, carrying proof of vaccination, understanding and complying with health requirements, and covering costs of all health documentation.

13.7 Destination-Specific Requirements

Each destination may have unique requirements including specific visa types for different purposes such as tourism, business, or education; proof of onward travel; proof of sufficient funds; hotel reservations or invitation letters; and background checks or police clearances. We will inform you of known requirements for your specific booking.

13.8 Relocation Services - Additional Requirements

For relocation services, additional documentation typically includes long-term visa or residence permit applications, apostilled documents such as birth certificates or marriage certificates, criminal background checks, proof of income or financial stability, education or professional credentials, and housing contracts or proof of accommodation. We provide guidance but cannot guarantee approval.

14. Relocation Services-specific Terms and Conditions

14.1 Nature of Relocation Services

Relocation services provide guidance, support, and coordination for international moves. We provide expert advice based on lived experience, connections to trusted service providers, practical support through relocation process, cultural integration resources, and ongoing mentorship and check-ins. We do not provide legal advice as we are not attorneys, immigration legal services though we connect you with attorneys, financial advice or investment guidance, guarantees of successful relocation, guarantees of visa or permit approval, housing guarantees or real estate services, or employment services or job placement.

14.2 Location Scout Package

The Location Scout Package includes five to seven days of immersive destination exploration, accommodation arrangements during scout visit, neighborhood tours with cultural context, introduction to expat communities and local contacts, three to five property viewings with

guidance, comprehensive orientation covering banking, healthcare, schools, and daily life, detailed cost of living analysis, connection with immigration attorneys for consultation, comprehensive written feasibility report, and thirty days post-visit email and phone support. This package does not guarantee you will find suitable housing, does not guarantee immigration attorney will accept your case, does not guarantee you will decide to relocate, and properties shown are examples as we do not control availability. The feasibility report is advisory only and not legal or financial advice.

14.3 Full Relocation Package

The Full Relocation Package includes everything in Location Scout Package plus comprehensive pre-departure planning and timeline, housing procurement support and lease negotiation, visa application management and immigration attorney liaison, shipping and logistics guidance for possessions, on-ground arrival support including airport pickup, first-week intensive orientation, complete practical setup coordination covering banking, phone, utilities, healthcare, and driver's license, cultural integration resources and language learning connections, structured check-ins at thirty, sixty, and ninety days, and ongoing mentorship through first ninety days. We coordinate and guide but you make final decisions. We cannot guarantee visa or permit approval, housing availability or lease approval, successful adjustment or happiness, control over third-party service providers, employment opportunities, or your financial solvency.

14.4 Visa and Immigration Support

We provide coordination and guidance, not legal services. We connect you with qualified immigration attorneys with whom you contract directly, and we are not parties to that relationship. Attorney fees are separate and your responsibility. We cannot guarantee visa or permit approval. Immigration processes can change, and timing and requirements may shift. You are ultimately responsible for visa compliance, and visa denials do not entitle you to refunds from us.

14.5 Housing Assistance

We help you find and evaluate housing options, but we do not own or control properties shown, do not guarantee availability, pricing, or landlord approval, and you are responsible for lease agreements and deposits, understanding lease terms, and due diligence on properties. We are not real estate agents or property managers, and housing market conditions can change rapidly.

14.6 Timeline and Duration

Relocation is a complex process requiring flexibility. Timelines are estimates based on typical scenarios. Delays can occur due to visa processing, housing availability, and other factors. We will work diligently but cannot guarantee specific timelines, and additional fees may apply if services extend beyond estimated timeframes.

14.7 Financial Considerations

You are responsible for all costs of relocation including moving, shipping, and deposits; cost of living in destination; housing deposits and rent; visa and legal fees; all setup costs such as utilities and furniture; buffer funds for unexpected expenses; and ongoing financial sustainability. We strongly recommend maintaining minimum six to twelve months living expenses saved, emergency fund beyond relocation costs, stable income source or significant savings, and financial planning with qualified advisors.

14.8 Emotional and Psychological Readiness

Relocation involves significant stress and adjustment. Culture shock is normal and expected. Homesickness and loneliness are common. Frustration with bureaucracy and logistics is typical. Relationship strains may occur, and questioning your decision is normal. We provide emotional support and mentorship, realistic expectations and preparation, connection to mental health resources when needed, and ongoing check-ins during critical adjustment period. We do not provide therapy or clinical mental health services, guarantee of emotional satisfaction or happiness, or solution to pre-existing mental health challenges. You should consider whether relocation will genuinely address your needs, whether you have adequate support systems, whether you are fleeing problems or moving toward growth, and whether you need therapeutic support before or during relocation.

14.9 Client Screening for Relocation Services

We reserve the right to decline relocation services to clients who are in acute mental health crisis, have unrealistic expectations we cannot manage, lack financial resources for sustainable relocation, cannot obtain necessary visas or permits, show signs of impulsivity without adequate planning, or demonstrate inability to handle stress or ambiguity. This protects both you and our business reputation.

14.10 Post-Relocation Support

After the initial ninety-day intensive support period, you are expected to be largely self-sufficient. We remain available for questions and guidance. Additional support may be

available for fees. We maintain relationships but cannot provide indefinite services, and you should have developed local support networks by this time.

14.11 Relocation Changes or Cancellation

If you cancel relocation services, standard cancellation fees per Section 8.3 apply, work already performed is non-refundable, third-party deposits for housing or attorneys are non-refundable, and you are responsible for any supplier cancellation fees. If we terminate services due to client breach, no refunds will be provided, you remain liable for any fees incurred, and you are responsible for completing relocation independently. If we cannot provide services due to force majeure, provisions of Section 18 apply, we will work with you to find solutions, and partial refunds may be provided for undelivered services.

We typically do not book international flights, but when we do, airline tickets are subject to airline rules and restrictions. Ticket rules vary by airline, fare class, and route. Most tickets are non-refundable or have high change fees. We will inform you of ticket restrictions before purchase. Schedule changes are controlled by airlines, not us. We are not responsible for flight delays, cancellations, or changes. We will assist with rebooking but fees apply per airline policy.

15.5 Hotels and Accommodations

For hotels and accommodations we book, policies vary by property. Some require non-refundable deposits. Cancellation deadlines vary, typically twenty-four to seventy-two hours before check-in. We will inform you of specific property policies. Quality and service levels may vary. We select properties based on research but cannot guarantee your satisfaction. Issues with hotels should be addressed directly with hotel first. We will assist with serious problems but cannot guarantee resolution.

For ground transportation such as transfers or private vehicles, third-party operators provide services. Quality and reliability vary. We select trusted operators but cannot guarantee performance. You must communicate your needs clearly including flight times and luggage. Vehicle types may vary based on availability. Delays can occur due to traffic, weather, or vehicle issues. We are not liable for missed connections due to transportation delays.

15.7 Tours and Activities

For tours and activities we arrange, third-party tour operators provide services. Group tours may include other travelers not booked through us. Itineraries are subject to change by operators. Minimum participants may be required. Weather may affect activities. Physical requirements may apply. We rely on operator descriptions, and actual experiences may vary. We will assist with complaints but cannot guarantee satisfaction.

15.8 Travel Service Commissions

We earn commissions from Fora Travel and suppliers. Commissions do not affect prices you pay. Commission rates vary by supplier and service. We may also charge service fees for complex itineraries. Service fees and commission structures will be disclosed.

16. Group Travel Experiences

16.1 Nature of Group Travel Experiences

Group travel experiences are small group journeys typically for six to twelve participants featuring curated programming and facilitation, shared accommodations and meals, cultural activities and excursions, group dynamics and community building, and leadership by Beneath the Map Travel founders or facilitators.

16.2 Experience Inclusions and Exclusions

Standard group travel inclusions are accommodation as specified in experience description, meals as specified with typically most meals included, scheduled activities, workshops, and excursions, ground transportation for scheduled group activities, leadership and facilitation, experience materials and resources, and airport transfers if specified in experience description. Unless specified, the following are excluded: international airfare, travel insurance which is mandatory as detailed in Section 10, personal expenses, optional activities during free time, alcoholic beverages, gratuities for local guides and service providers, spa treatments or personal services, and single room supplement if you want private room.

16.3 Registration

Group travel bookings require completed registration form with all required information, $1,500 per person non-refundable deposit, acceptance of these Terms, and proof of travel insurance by thirty days before departure.

16.4 Shared Accommodations

Group experiences typically feature twin-share accommodations with two per room. We will match you with a same-gender roommate unless you book with companion. We do our best to match compatible roommates but cannot guarantee satisfaction. Single room supplements are available for additional fee subject to availability. Room types and configurations are subject to availability and property constraints.

16.5 Group Dynamics

Group travel experiences involve interacting closely with other participants, sharing experiences and vulnerabilities, respecting others' privacy and boundaries, contributing positively to group energy, managing personality differences respectfully, and participating fully or communicating need for space. We reserve the right to remove participants who disrupt the group, refuse service to individuals who violate code of conduct, and provide no refunds for removal due to misconduct.

16.6 Schedule and Programming

Daily schedule will be provided before departure. Schedule is subject to change based on weather, local conditions, and group needs. Some flexibility and spontaneity is built into programming. Mandatory activities will be clearly designated. Free time is included for rest and independent exploration. We reserve right to modify activities for safety or logistical reasons.

16.7 Physical and Emotional Demands

Group travel experiences may be physically and emotionally demanding including walking, hiking, or other physical activities; hot or cold climates; varied accommodation conditions; emotional processing and vulnerability; group process and interpersonal dynamics; limited privacy and personal space; and potential culture shock or discomfort. You must assess your readiness for these demands, disclose relevant health or mental health concerns, communicate your needs to facilitators, take responsibility for your self-care, and know when to opt out of activities that don't serve you.

16.8 Experience Cancellations

See Section 8.4 for experience-specific cancellation fees. If we cancel an experience due to insufficient enrollment, we will notify you no later than forty-five days before departure, you will receive full refund of all payments, we may offer alternative experience dates at your option, and we are not responsible for non-refundable airfare or other expenses.

16.9 Photography and Media Release

By participating in a group travel experience, you acknowledge that photos and videos may be taken during the experience, we may use images for marketing and promotional purposes, you may appear in images used publicly, you grant us rights to use such images without compensation, you may request to opt out of photos by notifying us, and we will respect reasonable requests not to photograph you.

17. Digital Products

17.1 Digital Product Types

Digital products include destination guides such as "Is Moving to Africa Right for You?", country-specific relocation resources, assessment tools and self-evaluation workbooks, travel planning templates, educational content and mini-courses, video or audio content, and membership communities if offered.

17.2 Purchase and Delivery

Digital products are sold via our website. Payment is required at time of purchase. Products are typically delivered immediately via email or download link. You are responsible for providing accurate email address and for downloading within any specified timeframe.

17.3 Non-Refundable Policy

Digital products are generally non-refundable once delivered or accessed. Exceptions exist if you request refund within twenty-four hours of purchase and have not accessed or downloaded product, if product is defective or materially different than described, or if delivery fails due to our error. No refunds will be provided for change of mind, failure to download within specified timeframe, dissatisfaction with content which is subjective, inability to use product due to technical limitations on your end, or loss of downloaded files.

17.4 Intellectual Property and Usage Rights

Digital products are protected by copyright. By purchasing, you receive limited license to access and use product for personal, non-commercial use, download for personal reference, and print for personal use if applicable. You may not share, distribute, or resell products; reproduce for commercial purposes; modify or create derivative works; remove copyright notices or attribution; upload to file-sharing or public platforms; or share login credentials for membership areas. Violation of these terms may result in termination of access without refund, legal action for copyright infringement, and liability for damages.

17.5 Updates and Revisions

Information in digital products may become outdated. We may update products periodically but are not obligated to provide updates. Updated versions may be provided at our discretion. Access to updates depends on product type and our policies.

17.6 Accuracy Disclaimer

While we strive for accuracy, information is provided for educational purposes, content reflects our opinions and experiences, rules, regulations, and conditions change frequently, you must verify information with official sources, and we are not liable for decisions based on product content. See Section 20 for limitations of liability.

18. Force Majeure and Unforeseen Circumstances

18.1 Force Majeure Definition

"Force Majeure Event" means any event or circumstance beyond our reasonable control, including but not limited to natural events such as earthquakes, tsunamis, hurricanes, floods, volcanic eruptions, fires, mudslides, avalanches, extreme weather conditions, and natural disasters of any kind; public health events including pandemics, epidemics, disease outbreaks, quarantines, health emergencies, and public health restrictions or lockdowns; political and civil events such as war, armed conflict, invasion, terrorism or threat of terrorism, civil unrest, riots, demonstrations, coups, political instability, and government orders or restrictions; labor and infrastructure issues including strikes, labor disputes, supplier bankruptcy or insolvency, critical infrastructure failures, and transportation disruptions; and any other cause beyond our reasonable control.

18.2 Impact on Services

If a Force Majeure Event occurs, we may be unable to provide all or part of your booked services, may need to modify itineraries or arrangements, may need to cancel bookings entirely, and delays may occur.

18.3 Cancellation Due to Force Majeure

If we cancel your booking before departure due to Force Majeure, you will receive credit or voucher for future travel equal to payments made, valid for twenty-four months from date of original booking, which can be applied to any of our services. No cash refunds will be provided unless we receive refunds from suppliers. We will work to rebook you on alternative dates if desired. You are not entitled to compensation beyond the credit.

If Force Majeure interrupts services after commencement, we will provide reasonable assistance in arranging alternative services. You are responsible for costs of alternative services unless we recover funds from suppliers. Any refunds depend on supplier refund policies, and we are not liable for additional costs you incur.

If you cancel due to Force Majeure directly preventing your travel, standard cancellation fees per Section 8 may be waived at our discretion. You may receive credit for future travel. Refund depends on supplier refund policies. Travel insurance should cover circumstances beyond our control. We will work with you in good faith but cannot guarantee refunds.

18.4 Government Travel Warnings and Restrictions

If official government travel warnings or restrictions are issued, we will inform you as soon as we become aware, may cancel or modify your booking, and you may have right to cancel per Section 18.3. Travel insurance should cover government warnings in most policies.

18.5 Supplier Failure

If Third-Party Suppliers fail to provide services due to insolvency, bankruptcy, or other reasons, we will use reasonable efforts to arrange alternatives. We are not liable for supplier failures. Refunds depend on ability to recover funds from suppliers. This is why travel insurance is mandatory. Our financial protection does not cover all Third-Party Suppliers.

18.6 No Liability for Force Majeure

We are not liable for failure to provide services due to Force Majeure, additional costs you incur due to Force Majeure, losses arising from Force Majeure, or changes or cancellations due to Force Majeure.

18.7 Travel Insurance Coverage

This section explains why travel insurance is mandatory. Insurance should cover trip cancellation due to Force Majeure, trip interruption due to Force Majeure, additional expenses incurred due to Force Majeure, and evacuation if necessary.

19. Risk Acknowledgment and Assumption of Risk

19.1 Inherent Risks of Travel

By booking with us, you acknowledge and accept that travel, particularly international travel and adventure travel, involves inherent risks including but not limited to health and safety risks such as illness or injury, accidents whether vehicle or recreational, exposure to infectious diseases, altitude sickness or climate-related illness, food or waterborne illness, inadequate or delayed medical care, medical evacuation challenges, and exposure to unfamiliar flora or fauna. Infrastructure and service risks include transportation delays or failures, accommodation quality variations, power outages or utility failures, communication limitations, road conditions and transportation safety standards, and different safety standards than home country. Security risks encompass crime including theft, robbery, assault, and fraud; political instability; civil unrest or demonstrations; terrorism; kidnapping in certain destinations; and local conflicts. Cultural and social risks involve cultural misunderstandings, language barriers, different legal systems and standards, discrimination or harassment, and different social norms regarding

gender, sexuality, and religion. Environmental risks include natural disasters, severe weather, extreme temperatures, high altitude, and remote locations with limited access to services.

19.2 Destination-Specific Risks

You acknowledge that destinations in Africa and Latin America may present heightened risks including different standards of infrastructure and safety, higher rates of certain diseases, more limited access to emergency services, greater cultural differences from Western norms, varying levels of political stability, and higher crime rates in certain areas. We will provide honest assessments of destination-specific risks, safety guidelines and recommendations, pre-departure information about precautions, and emergency contacts and support. You must research destinations thoroughly, review official travel advisories from sources such as U.S. State Department or UK Foreign Office, assess your personal risk tolerance, take recommended precautions, and follow safety guidance provided.

19.3 Voluntary Assumption of Risk

By booking with us, you voluntarily assume all risks associated with your travel, including those described above and any others not specifically listed. You acknowledge that you have been informed of these risks, have had opportunity to ask questions and obtain more information, choose to proceed despite these risks, accept personal responsibility for your safety, and will not hold us liable for risks that materialize.

19.4 Personal Responsibility

You are responsible for assessing whether you are physically and mentally fit for planned activities, following instructions and safety guidelines, avoiding unnecessary risks, being aware of your surroundings, securing your belongings, making prudent decisions about your safety, seeking medical attention when needed, following local laws and customs, and purchasing and maintaining adequate travel insurance.

19.5 No Guarantees

We cannot and do not guarantee your safety or security, that you will not become ill or injured, that services will be provided exactly as described, that you will enjoy the experience, that cultural adjustment will be easy, that relocation will meet your expectations, or that all planned activities will occur as scheduled.

19.6 Waiver of Claims

To the maximum extent permitted by law, you waive any claims against Beneath the Map Travel for injury, illness, or death arising from inherent travel risks; property loss or damage during travel; disappointment with services or experiences; consequences of your own decisions and actions; harm caused by Third-Party Suppliers; or events beyond our control. This waiver is a material inducement for us to provide services. Without this waiver, we would not offer these services.

20. Limitation of Liability

20.1 No Liability for Third-Party Suppliers

Beneath the Map Travel acts as an intermediary arranging services provided by independent third parties including airlines, rail companies, and other transportation providers; hotels, guesthouses, and accommodation providers; tour operators and activity providers; guides, drivers, and facilitators; restaurants and food service; immigration attorneys and consultants; and all other service providers. We do not own, operate, or control these Third-Party Suppliers. Therefore, we are not liable for acts, omissions, negligence, or willful misconduct of Third-Party Suppliers; quality, safety, or suitability of services provided by Third-Party Suppliers; failure of Third-Party Suppliers to perform; injury, illness, death, or property damage caused by Third-Party Suppliers; delays, cancellations, or changes by Third-Party Suppliers; or defects in equipment, vehicles, or facilities operated by Third-Party Suppliers. Our responsibility is limited to reasonable care in selecting Third-Party Suppliers, providing accurate information about services to extent available, coordinating bookings and arrangements, assisting with problems when they arise, and maintaining appropriate insurance.

20.2 Disclaimer of Warranties

To the maximum extent permitted by law, we provide all services "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, warranties of fitness for a particular purpose, warranties of accuracy or completeness, warranties that services will meet your expectations, and warranties that services will be uninterrupted or error-free.

20.3 Maximum Liability Cap

To the maximum extent permitted by law, our total liability to you for any and all claims arising from or related to your booking or use of our services shall not exceed the total amount you paid to us for the specific services giving rise to the claim. This limitation applies regardless of the legal theory of liability whether contract, tort, negligence, strict liability, or other; whether

we were advised of the possibility of damages; or whether the limited remedy fails of its essential purpose.

20.4 Exclusion of Consequential Damages

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits or revenue; loss of data or information; loss of opportunity; emotional distress; reputational harm; cost of substitute services; or any damages beyond direct, actual losses. This exclusion applies even if such damages were foreseeable, we were advised of the possibility, or the limited remedy fails of its essential purpose.

20.5 Geographic and Regulatory Limitations

Different jurisdictions have different laws regarding limitation of liability. Where local law prohibits these limitations or requires different terms, these Terms shall be modified to the minimum extent necessary to comply with local law, all other provisions remain in full force, and the limitations apply to the fullest extent permitted by applicable law.

20.6 Independent Obligations

Nothing in these limitations affects your obligation to pay for services rendered or our right to recover payment owed.

20.7 Exceptions to Limitations

These limitations do not apply to liability that cannot be excluded or limited under applicable law, death or personal injury caused by our gross negligence or willful misconduct, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable consumer protection laws.

20.8 Reasonableness and Acknowledgment

You acknowledge that these limitations are reasonable given the nature of our services, our pricing reflects these limitations, we could not operate our business without these limitations, you have been advised to purchase travel insurance to cover risks we do not cover, and you have opportunity to decline our services if these limitations are unacceptable.

21. Indemnification

21.1 Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless Beneath the Map, LLC, and our officers, directors, employees, agents, contractors, successors, and assigns (collectively, "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, and fees including reasonable attorneys' fees arising from or related to your conduct including your violation of these Terms, your violation of any applicable law or regulation, your negligence or willful misconduct, your violation of rights of any third party, your failure to comply with instructions or safety guidelines, and your behavior during services including damage to property. This obligation extends to your representations including any false or misleading information you provide, failure to disclose required information whether medical or legal, and misrepresentation of your fitness or eligibility. You are responsible for your actions during services including injury or damage you cause to others, property damage you cause, criminal acts you commit, harassment or inappropriate behavior toward guides or other travelers, and violation of local laws or customs. You are also responsible for third-party claims including claims by other travelers affected by your actions, claims by service providers for damage or breach, and claims arising from your relationships with third parties.

21.2 Defense and Settlement

If a claim subject to indemnification is brought, we may assume defense at your expense. You may not settle any claim without our prior written consent. We may settle claims in our discretion. You must cooperate fully with defense of claims and must provide truthful information and testimony.

21.3 Notice and Cooperation

You must promptly notify us of any claim or potential claim, cooperate fully in the defense, provide documents and information requested, and not admit liability or fault without our consent.

21.4 Survival

This indemnification obligation survives termination of these Terms and completion of services.

22. Dispute Resolution and Governing Law

22.1 Governing Law

These Terms and any disputes arising from or related to them or your booking shall be governed by the laws of the State of Wyoming, United States of America, without regard to its conflict of law provisions.

22.2 Informal Resolution

Before initiating any formal dispute resolution, you must contact us in writing describing the dispute. We will attempt to resolve the matter informally within thirty days. Good faith negotiation is required from both parties. Most disputes can be resolved through communication.

22.3 Arbitration Agreement

Any dispute, claim, or controversy arising from or relating to these Terms or your booking that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall be conducted by a single arbitrator. Location shall be Cheyenne, Wyoming or another location mutually agreed. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction. Each party bears its own attorneys' fees unless arbitrator awards fees to prevailing party. Discovery shall be permitted as determined by arbitrator. The following may be brought in court rather than arbitration: small claims court actions within jurisdictional limits, actions to enforce arbitration awards, and actions seeking emergency or injunctive relief.

22.4 Class Action Waiver

You agree that any arbitration or court proceeding shall be conducted on an individual basis only and not as a class action, consolidated action, or representative action. You waive any right to participate in class action lawsuits, serve as class representative or member, consolidate claims with claims of others, or pursue claims on behalf of others. This waiver is severable from the arbitration agreement. If the class action waiver is found unenforceable, the arbitration agreement remains enforceable for individual claims.

22.5 Jurisdiction and Venue

If arbitration does not apply or is held unenforceable, exclusive jurisdiction lies in state and federal courts located in Wyoming. You consent to personal jurisdiction in Wyoming, waive any objection to venue in Wyoming, and waive any objection based on inconvenient forum.

22.6 Waiver of Jury Trial

If claims are not subject to arbitration, you waive your right to jury trial for any dispute arising from or related to these Terms or your booking.

22.7 Limitation Period

Any claim must be brought within one year of the date the claim accrues or it is forever barred. Claims accrue on date of service or when issue discovered for service issues, on date of booking or when issue discovered for booking issues, and on date payment was due for payment issues. This limitation period applies notwithstanding any statute of limitations that might otherwise apply.

22.8 Legal Fees

In any dispute resolution, each party typically bears its own legal fees. Prevailing party may recover reasonable attorneys' fees if arbitrator or court awards fees or local law provides for fee recovery. We may recover collection costs for unpaid amounts owed.

22.9 Severability of Dispute Resolution Provisions

If any provision of this Section 22 is held unenforceable, remaining provisions remain in effect, unenforceable provision shall be modified to minimum extent necessary, and overall intent to resolve disputes through arbitration shall be preserved.

26. Complaints and Feedback

26.1 Complaint Procedure

If you have a complaint about our services, follow these steps. During service delivery, raise issues immediately with service providers or our staff, document issues with photos, dates, times, and details, and allow us opportunity to resolve issues in real-time. For formal written complaint, submit within thirty days of service completion to info@beneaththemaptravel.com, including booking reference, detailed description, supporting documentation, and desired resolution. We will acknowledge receipt within five business days, investigate thoroughly, respond with findings and proposed resolution within thirty days, and may request additional information. We will work in good faith toward fair resolution. Resolutions may include refund, credit, service remedy, apology, or no action if complaint is unfounded. Our decision will be communicated in writing.
